Solar Studios' End-User Licence Agreement
     
Please read the terms of the following licence agreement before using Solar sampler files. By installing the Solar sample libraries, you agree to become bound by the terms of this licence agreement. If you do not agree with the terms of the licence agreement, do not install and use the Solar samplers.
 
1. Definitions. For the purposes of this document, Dmitryi S. Sizónenco (alternate spellings: Dmitry Sizonenko, Cyrillic Дмитрий Сергеевич Сизóненко), webmaster and owner of the Solar Studios website and production studio, shall be defined as the "Licenser". "Sampling" is a technique used for recording real-world sound waves and storing them in a computer file format, commonly known as PCM (pulse-code modulation) waveform. You, the end-user of the software product, are defined as the "Licensee". Sampled instruments, consisting of libraries of sampled sounds in any computer musical software format or PCM wave format, bought by the Licensee from Solar Studios' website or any authorised dealer of Solar Studios, shall be defined as the "Product".
 
2. Intellectual Property. The content of the sound sample files in any software sampler format is property of the Licenser. All samples contained in any Product of the Licenser are licensed by the Licenser for use by the Licensee, not sold for any use.

3. Terms of Use. This licence agreement grants the Licensee a right to use the sound samples contained in the Product for purposes of non-commercial and commercial music composition, non-commercial and commercial radio and TV broadcasting (on the Internet as well as via conventional radio waves), any programme/show sound effects and any live sound playback, except when this is in conflict with paragraph 4 (Use Restrictions). This right of use is non-transferrable and is limited to one person, the original buyer of the Product, the Licensee. The Licensee may install and use the Product on any number of his own computer workstatiions.
 
4. Use Restrictions. This licence agreement completely forbids the resale, re-licensing, leasing, renting, transfer, loaning, gifting of the Product under any conditions, also any kind of reuse of the sound samples contained in the Product in any kind of software.

5. Guarantee and Quality Responsibility. The nature of computer software makes it impossible to insure any computer software is free of errors. Therefore there is no guarantee whatsoever of the Product or its host software being harmless. The Licenser shall not be held liable for any damage occurring from the use of the Product. The use of Product and any resulting damage, physical, moral or psychological, is entirely the responsibility of the Licensee. That said, the Licenser will make an effort to repair and correct any issues with the Product itself, such as corrupt wave files or erroneous tuning. Updates containing fixes to original Product files may be issued by Licenser from time to time, however there is no obligation whatsoever on the Licenser to provide updates at all, or to suit any deadline. That said, if the Licensee encounters a serious problem with the Product, he is encouraged to give feedback so as to clarify, fix and improve the Product.
 
At no time or condition can the Licensee ever file any legal claim over damage of any kind, direct or indirect, caused by the Product. The Licenser provides no guarantee or claims that the Product fulfils any of the Licensee's requirements or purpose, or that it works correctly with any host software used by the Licensee. Any responsibility for correct selection and operation of hardware and software, Product included, is entirely held by the Licensee.
 
6. Use Within Software. Software licensing terms, e. g. use within a software application, such as, but not limited to, a computer game, are subject to a separate licence agreement to be granted by the Licenser.
